Am I Eligible for a German Student Visa? The 5 Hard Gates

Eligibility for a German student visa is not a score. It is a sequence of five conditions, each resolving to pass or fail on its own terms. A strong profile on four gates does not compensate for a failure at the fifth, and academic merit does not substitute for a document that is structurally absent. This article documents what each gate tests, which provision it rests on, and where an application is incomplete rather than merely weak.

The five gates, in sequence

The gates are ordered by dependency, not difficulty. Gate 1 produces the document Gate 3 is sized against, and Gate 2 is checked before the mission opens the substantive file. Working out of order is the most common source of avoidable delay.

Gate 1 · Admission or conditional admission

§16b Abs. 1 AufenthG attaches the residence title to a study purpose that must already exist on paper. The mission is not assessing whether a university would probably take you.

• An unconditional admission letter (Zulassungsbescheid) from a German higher education institution satisfies the gate directly.
• A conditional admission (bedingte Zulassung) also satisfies it, provided the condition is a study-preparatory measure such as a Studienkolleg place or a qualifying language course.
• An application receipt, a uni-assist acknowledgment, or a portal status of "under review" does not satisfy it. There is no partial credit here.
• The admission also fixes the programme duration, which determines how the financial gate is sized.

Gate 2 · The APS certificate

Jurisdiction-specific. For applicants filing in India, the Akademische Prüfstelle certificate is a precondition of the file, not a supporting exhibit.

• Without a valid APS certificate the mission does not proceed to a substantive decision.
• APS verifies academic documents. It sits upstream of the visa interview and is independent of it.
• The certificate has its own processing time. Treated as an afterthought, it becomes the binding constraint on the timeline.
• An APS refusal is not a visa refusal, but it removes the ability to file. Reapplication is a separate procedure.

Gate 3 · Secured livelihood

§5 Abs. 1 Nr. 1 AufenthG requires a secured livelihood. For 2026 the reference figure, derived from the BAföG rate, is 11.904 EUR for the first year, released at 992 EUR per month. The gate accepts alternative routes, but each must clear the same threshold.

• Blocked account (Sperrkonto): the full annual amount is deposited before the application is filed, not after.
• Recognised scholarship: the monthly award must reach the reference figure. A shortfall must be covered by another route.
• Declaration of commitment (§68 AufenthG): a sponsor resident in Germany accepts liability. Some Ausländerbehörden assess the sponsor's solvency only once the full file is in.
• Parental income and asset proof: accepted by some missions, but the least standardised route.
• Applicants under §17 Abs. 2 AufenthG (applicant visa, not yet admitted) are measured against a higher figure of 1.091 EUR per month.

Gate 4 · Health insurance cover

Insurance is not a separate ask. It is part of the secured-livelihood test, which is why an uninsured file fails on the same provision as an underfunded one.

• For the visa, cover must exist from the date of intended entry. Incoming or travel cover is typically what the mission sees.
• After arrival the position changes: students are ordinarily brought into the statutory system, and the university asks for confirmation before enrolment completes.
• Cover lapsing between visa issue and enrolment creates a gap that surfaces at the Ausländerbehörde, not at the embassy.

Gate 5 · The general conditions of §5 AufenthG

The gate applicants most often overlook, because it is not about the study project at all. It is the baseline every residence title must satisfy.

• A valid passport whose validity comfortably outlasts the intended stay.
• Identity and nationality clarified. Inconsistencies across documents, including transliterated name variants, read as a clarification problem.
• No grounds for expulsion, and no public interest opposing entry.
• A missing document makes the file incomplete. A statement contradicted by another document raises credibility, which is a slower conversation.

What the gates do not test

Several things applicants worry about are not gates. They shape the decision at the margin rather than blocking the file.

• Language proficiency is tested by the university and reflected in the admission. The mission checks that the language of instruction and your certificate cohere.
• Academic plausibility at interview: whether the programme follows sensibly from your previous degree. Discretion, not a threshold.
• Grades and prestige matter to the admission, which is Gate 1. They carry no independent weight at the visa stage.
• Prior refusals do not bar a new application, but an unchanged file invites an unchanged outcome.
