Am I Eligible for a German Student Visa? The 5 Hard Gates

Eligibility for a German student visa is not a score. It is a sequence of five conditions, each resolving to pass or fail on its own terms. A strong profile on four gates does not compensate for a failure at the fifth, and academic merit does not substitute for a document that is structurally absent. This article documents what each gate tests, which provision it rests on, and where an application is incomplete rather than merely weak.

The five gates, in sequence

The gates are ordered by dependency, not difficulty. Gate 1 produces the document Gate 3 is sized against, and Gate 2 is checked before the mission opens the substantive file. Working out of order is the most common source of avoidable delay.

Gate 1 · Admission or conditional admission

§16b Abs. 1 AufenthG attaches the residence title to a study purpose that must already exist on paper. The mission is not assessing whether a university would probably take you.

Gate 2 · The APS certificate

Jurisdiction-specific. For applicants filing in India, the Akademische Prüfstelle certificate is a precondition of the file, not a supporting exhibit.

Gate 3 · Secured livelihood

§5 Abs. 1 Nr. 1 AufenthG requires a secured livelihood. For 2026 the reference figure, derived from the BAföG rate, is 11.904 EUR for the first year, released at 992 EUR per month. The gate accepts alternative routes, but each must clear the same threshold.

Gate 4 · Health insurance cover

Insurance is not a separate ask. It is part of the secured-livelihood test, which is why an uninsured file fails on the same provision as an underfunded one.

Gate 5 · The general conditions of §5 AufenthG

The gate applicants most often overlook, because it is not about the study project at all. It is the baseline every residence title must satisfy.

Structural reading

Applicants tend to model the visa as a persuasion exercise: build the strongest case and hope the officer is convinced. The gates do not work that way. Four are documentary and binary, and the officer has little room to be persuaded. Persuasion enters only where the file is complete and the question shifts to plausibility. If you are arguing your way past a gate, you are almost certainly at a gate that does not take arguments.

What the gates do not test

Several things applicants worry about are not gates. They shape the decision at the margin rather than blocking the file.

The 11.904 EUR figure and the 1.091 EUR applicant rate are adjusted annually and mission practice varies. Confirm the current amounts and accepted proof formats with the German mission responsible for your jurisdiction before transferring funds.
