Why Family is conditional

A family residence permit is not held in its own right. It is derived from a sponsor's status and a family relationship, and held by maintaining the conditions around them. The path has three phases. Each phase has its own gates, its own dependencies, its own failure modes.

Phase 1

Pre-Visa

The right family constellation, marriage or birth documents with the India verification step, A1 German where required, secured livelihood and housing where required, and the visa application from India. Each component depends on the others.

Phase 2

In-Country

Anmeldung, residence permit issuance, and a status that is derived from the sponsor's permit and the family relationship. A change in the sponsor's status, the relationship, or the household income triggers reassessment.

Phase 3

Toward Independence

An independent right of residence after the qualifying period (§31), the path to Niederlassungserlaubnis, and the transitions if the relationship or the sponsor's situation changes.

Failure on the Family path tends to fall into three structural categories. Each category has its own recovery procedure - or no recovery at all.

Category 1

Sponsor dependency break

The status that the permit is derived from changes - the sponsor loses their permit or leaves Germany, or the relationship ends. The derived status enters reassessment.

Category 2

Threshold drops

Household livelihood falls below the required level, or the housing is no longer adequate. At renewal these conditions are re-checked and can trigger reassessment.

Category 3

Status loss

The qualifying period for an independent right is not met before a relationship breakdown, or the basis for the derived permit collapses. Residence basis is lost.

All thresholds are set against the current 2026 figures - the A1 language gate and its exemptions, the Bürgergeld-based livelihood reference, housing standards, and the India document-verification procedure (the Hague Apostille does not apply between Germany and India). Legal references point to the Aufenthaltsgesetz as in force. When figures or rules change, the affected modules are updated - included in your year of access.

How long is access valid?

Can I switch to Study or Work later?
