Why Family is conditional

Family residence is dependency-based: the dependent’s status is bound to the sponsor’s permit, income, and housing. Each phase has its own gates, its own dependencies, its own failure modes.

Phase 1

Pre-Reunion

Sponsor permit verification, A1 language gate, income sufficiency proof, housing space proof, visa application. Conditions evaluated together — one failure blocks the entire reunification.

Phase 2

In-Country

Anmeldung, residence permit issuance, integration obligations, dependency continuity. Status holds against the sponsor’s active permit and ongoing income/housing conditions.

Phase 3

Independence

After 3 years of marriage in Germany: eigenständiges Aufenthaltsrecht (§31). Path to Niederlassungserlaubnis after qualifying years. Separation from sponsor permit possible.

Risk zones

Failure on the Family path tends to fall into three structural categories. Each category has its own recovery procedure — or no recovery at all.

Category 1

Sponsor dependency break

The sponsor’s permit ends, the marriage ends, or the household structure changes. The dependent permit may collapse or convert depending on duration and conditions.

Category 2

Threshold drops

Income falls below the sufficiency baseline, or housing no longer meets the space requirement. Triggers reassessment at next renewal and may block extension.

Category 3

Status loss

Reunification denied at visa stage or residence basis collapses without independence path. Recovery requires new legal basis — not document resubmission.
