§16b AufenthG

Legal basis - Residence Act for study purposes

Why Study is conditional

A student residence permit is not granted by intent. It is granted on conditions and held by maintaining them. The path has three phases. Each phase has its own gates, its own dependencies, its own failure modes.

Phase 1

Pre-Visa

APS Certificate, university admission, blocked account funding, language proof, visa application. Each step is sequential. Each delay shifts the entire timeline.

Phase 2

In-Country

Anmeldung, residence permit conversion, enrollment continuity, Ausländerbehörde appointments. Status is conditional on academic progress. Interruption triggers reassessment.

Phase 3

Post-Studies

18-month job search window after graduation. Transition to work permit (§18a/b) or self-employment. Permanent residence (Niederlassungserlaubnis) path begins here.

Six structural gates

The Study path moves through six gates in sequence. Each gate has its own conditions, dependencies, and trigger consequences.

01

APS Certificate

02

Admission Letter (Zulassung)

03

Blocked Account (Sperrkonto)

04

Visa Application

05

Enrollment Continuity

06

Post-Study Window

Conditions, thresholds, and trigger consequences per gate are documented in Module 5 / Matrix - included in Study Access.

Risk zones

Failure on the Study path tends to fall into three structural categories. Each category has its own recovery procedure - or no recovery at all.

Category 1

Timeline misalignment

Components of the visa application drift out of sync with each other or with administrative cutoffs.

Category 2

Threshold drops

Conditions held at entry are no longer met during stay. Triggers reassessment at renewal.

Category 3

Status loss

Residence basis collapses. Status cannot be restored through documents alone.

Twelve documented failure scenarios - with cause, trigger, and recovery path - are inside Module 8 / Scenarios.

Frequently asked questions

Common questions about Study Access - what it covers, how it works, and what stays current.

What does Study Access cover?

Eight content modules in two phases. Before Germany (4 modules): Roadmap, Document Pack, Visa Matrix, Scenarios Before. In Germany (4 modules): Matrix, Transition Map, Renewal Pack, Scenarios. All scoped to the Study track from India to Germany.

Is this legal advice?

No. bay.in provides structural information - legal references, thresholds, conditions, and trigger consequences as documented in the Aufenthaltsgesetz and current administrative practice. We do not represent applicants and do not provide individual case advice. For case-specific guidance, consult a licensed German Rechtsanwalt.

How current is the content?

All thresholds are set against the current 2026 figures (Sperrkonto, language gates, post-study window). Legal references point to the Aufenthaltsgesetz as in force. When figures or rules change, the affected modules are updated - included in your year of access.

How long is access valid?

12 months from purchase. One-time payment, no auto-renewal, no subscription. After 12 months, access ends unless you renew - you decide.

Can I switch to Work or Family later?

Yes. Each track is purchased separately, or you can choose Full Access for all three plus cross-track content. If you start with Study and later want Work or Family, you can purchase that track separately at the price valid at that time.

Who is this built for?

Indian applicants relocating to Germany on a study basis - either Bachelor, Master, or doctoral level. The content assumes no prior knowledge of German residence law but does not simplify the structure. If you want clarity before commitment, this is built for you.
